(ConservativeSense.com) – An undocumented immigrant facing a murder charge in North Carolina was reportedly ordered to be deported two years prior by US Immigration and Customs Enforcement (ICE) but was never sent back over the border.
Eighteen-year-old Carlos Roberto-Diaz was arrested on Thursday, July 11, in relation to a shooting spree on Tuesday, July 9, involving multiple alleged assailants in Charlotte, North Carolina, the same night. Roberto-Diaz faces a single count of first-degree murder, conspiracy to commit murder, and assault with a deadly weapon. He also faces two counts for shooting into a vehicle or dwelling, and five attempted murder charges.
Roberto-Diaz, one of two suspects arrested in connection with the murder, was reportedly ordered to be deported in 2022. Immigration attorney Jamilah Espinosa told reporters that he was never expelled from the US, possibly because his lack of criminal history made him a lower priority. When he was 14, Roberto-Diaz was intercepted at the US-Mexico border in 2019 alongside his father; they were released into the US. Espinosa said the border was “saturated” at that time in 2019.
Another possible reason Roberto-Diaz wasn’t deported, according to Espinosa, is he may not have received a court notice. She said sometimes people allowed to stay leave the initial address reported to border patrol and then never receive the notice.
According to Charlotte Mecklenburg Police Department detectives, Roberto-Diaz and a 16-year-old accomplice left a house party early in the morning on July 9 and proceeded to drive around aimlessly and shoot at random people for about 30 minutes. They allegedly opened fire in areas in and around Nations Ford Road, Statesville Avenue, and Beatties Ford Road. The shooting spree is reported to have resulted in the death of 58-year-old Mustaffa Muhammad, who was on his way home from work when he was fatally shot.
