Boar’s Head Provisions Company Inc. has agreed to a preliminary settlement of $3.1 million in a class action lawsuit over a 2024 listeria outbreak. The settlement addresses claims that the company failed to disclose potential Listeria monocytogenes contamination on product labels. The lawsuit includes consumers nationwide who purchased recalled products before July 31, 2024.
Despite the company’s agreement to the settlement, it does not admit any wrongdoing. The preliminary settlement was filed in the US District Court for the Southern District of New York. If the settlement is approved, affected consumers can apply for full reimbursements by providing proof of purchase between May 10, 2024, and August 12, 2024. Consumers who do not have proof of purchase may still be eligible for “average retail price for up to two” products under the recall, per the settlement site.
