The Misuse Allegation

ESPN allegedly violated Federal Communications Commission rules by misusing the Emergency Alert System (EAS) tones during a promotional segment for the NBA season. This segment reportedly aired without an actual emergency occurring or any authorized test in place. Such use of EAS tones outside their intended purpose can lead to public confusion and risks to public safety.

The FCC has proposed a $146,976 fine against ESPN for these violations after tracing six instances of such misuse between October 20-24, 2023. The unauthorized transmission of EAS codes in this context breached Section 11.45(a) of the FCC’s rules, which dictates strict compliance to avoid false alarms. ESPN has thus far declined to provide a comment on this issue.
