Classified Docs Cases Tossed Out By Florida Judge

(ConservativeSense.com) – Judge Aileen Cannon has dismissed the classified documents charges against Donald Trump. Judge Cannon determined that Special Counsel Jack Smith’s appointment was unconstitutional just hours after the failed assassination attempt against the former President in Pennsylvania. Mr. Trump said he was “thrilled” that the Judge had exercised “courage and wisdom” in delivering her decision.

Cannon ruled that US Attorney General Merrick Garland had no Constitutional authority to appoint Jack Smith to prosecute the former President. This is Donald Trump’s second major legal reprieve in recent weeks, following the Supreme Court decision that he enjoys Presidential immunity for acts taken in the course of his formal duties.

The Department of Justice said it will appeal Judge Cannon’s decision. Jack Smith also hit back, saying the ruling “deviates from the uniform conclusion of all previous courts.”

The 37-count indictment accused Mr. Trump of keeping classified documents at his Mar-a-Lago estate in Florida and lying to investigators. Garland appointed Jack Smith to lead the prosecution in 2022. It is one of two cases he is pursuing against the former President, and Judge Cannon made it clear that her ruling in the first case does not affect the second. Smith is also leading prosecution efforts to hold Trump accountable for his alleged role in the January 6 riots on Capitol Hill.

Legal experts suggest that Cannon’s ruling will ultimately be overturned because it conflicts with other courts, including the Supreme Court, but note that it buys time for Donald Trump as it is unlikely to conclude before the November Presidential election.

Reactions to Cannon’s decision were mixed, with some Democrats expressing astonishment. Senate Majority Leader Chuck Schumer called it a “breathtakingly misguided ruling,” while former federal prosecutor Neama Rahman said it was “stunning, to say the least.”

Mr. Trump denies wrongdoing and has pleaded not guilty to all charges. He said the Justice Department initiated the case to prevent him from mounting an effective Presidential campaign.
